   Defective Products

 

 

          Defective Products Litigation, otherwise known as “product liability,” is a highly specialized and immensely challenging field of law in which few law firms are willing to engage, and for good reason.  Typically, the opposing parties are large manufacturers so extremely defensive about their products that they are willing to devote unlimited resources to such litigation.  Oftentimes, such companies will expend huge sums in order to wear an injured party’s law firm into submission, preventing a just result by its economic power alone, irrespective of the relative safety of their product.

          Another reason that most law firm avoid product liability litigation is that, in order to do so successfully, the lawyers must effectively master the “engineering” aspects of a product in order to understand, and the articulate to a jury, how a product defect may have caused his or her client’s injury.

          At the Gast Law Firm, we tackled that problem so effectively that, in September, 1985, General Motors Corporation entered into what, at that time, was one of the largest-ever settlements for a single injured Plaintiff in Nebraska.  General Motors remains insistent that the amount of that settlement remains sealed to this day. That case involved a defective design of the fuel filler neck of the 1966 Chevrolet Camaro, and was filed in Cleveland, Ohio, since the vehicle was built in that State.

          In order to achieve that result, the Gast Law Firm lawyers and co-counsel were required to study and fully master the complex engineering principles of automotive fuel containment systems and design, and we maintain the ability and willingness to do so again.
